1. Agreement to Terms

These Terms of Service ("Terms") govern your access to and use of Fireform ("we," "us," or "our"), a form builder that lets you design forms, publish them as hosted pages, and collect responses. By creating an account or using our services, you agree to these Terms. If you do not agree, please do not use our services.

2. Definitions

• Platform means the Fireform website, dashboard, form builder, hosted forms, and related services.
• Subscriber or you means a person or organization that creates an account and uses the Platform.
• Respondent means a person who completes a form published by a Subscriber.
• Merchant of Record means Lemon Squeezy, which processes payments for the Platform.

3. Eligibility

You must be at least 18 years old to use Fireform. By using the Platform, you confirm that you meet this requirement, that the information you provide is accurate, and that you have the authority to accept these Terms on behalf of yourself or the organization you represent.

4. Accounts

Your account is created and secured through our authentication provider, Clerk. You are responsible for maintaining the confidentiality of your credentials and for all activity that occurs under your account. Please notify us immediately if you suspect any unauthorized access.

5. The Explore Plan and Publishing

The Explore plan lets you build and preview the product before you subscribe, so you can evaluate whether Fireform is right for you. Publishing forms and collecting live responses requires a paid plan. The features and limits of each plan are described on our pricing page and may change over time.

6. Subscriptions, Billing, and Taxes

Paid plans are billed through our Merchant of Record, Lemon Squeezy. Subscriptions renew automatically for the applicable billing period until you cancel. By subscribing, you authorize recurring charges through Lemon Squeezy until cancellation. Prices may change, and we will provide notice of any change before it applies to you. As Merchant of Record, Lemon Squeezy is responsible for collecting and remitting applicable taxes.

7. Cancellation and Refunds

You may cancel your subscription at any time. When you cancel, your plan remains active until the end of your current billing period, and you will not be charged again. Subscription fees are non-refundable except as described in our Refund Policy.

8. Acceptable Use

You agree not to use the Platform to:

• Violate any law or regulation, or infringe the rights of others.
• Collect personal data unlawfully or without a valid lawful basis.
• Send spam, phishing, or deceptive content, or distribute malware.
• Publish content that is illegal, harmful, harassing, or otherwise objectionable.
• Interfere with, disrupt, or attempt to gain unauthorized access to the Platform or its systems.
• Reverse engineer, copy, or resell the Platform except as permitted by law.

We may remove content or suspend accounts that violate these Terms or our policies.

9. Subscriber Responsibilities for Respondent Data

You are the data controller for the information you collect from Respondents through your forms, and you appoint Fireform as your data processor for that information. You are responsible for having a lawful basis to collect the data, providing appropriate privacy notices on your forms, obtaining any required consents, and responding to requests from Respondents about their data. Our handling of this data is described in our Privacy Policy.

10. Integrations

You may configure integrations and automations (for example, webhooks to services such as Zapier or Make.com) to send your form submission data to third-party services you choose. You are responsible for any integration you configure, the destinations you select, and the third parties that receive your data. Fireform does not send your data to these third parties automatically.

11. Intellectual Property

You retain ownership of the forms you create and the responses you collect. You grant us a limited license to host, store, and process this content as necessary to provide the Platform. Fireform and its licensors retain all rights to the Platform, including its software, design, and brand. You may not use our trademarks without our prior written consent.

12. Privacy

Our collection and use of information is described in our Privacy Policy, which forms part of these Terms.

13. Service Availability and Changes

The Platform is provided on an "as is" and "as available" basis. We do not guarantee that the Platform will be uninterrupted or without errors, and we may modify, suspend, or discontinue features at any time. We will aim to give reasonable notice of significant changes where practical.

14. Termination and Suspension

We may suspend or terminate your access to the Platform if you breach these Terms, if required by law, or to protect the Platform or its users. You may stop using the Platform at any time. Upon termination, your data is handled in accordance with our Privacy Policy.

15. Disclaimers

To the fullest extent permitted by law, we disclaim all warranties, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Platform will meet your requirements or that any data will always be available or without errors.

16. Limitation of Liability

To the fullest extent permitted by law, Fireform will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, revenue, or profits. Our total liability for any claim relating to the Platform will not exceed the amount you paid to us in the 12 months before the event giving rise to the claim.

17. Indemnification

You agree to indemnify and hold Fireform harmless from any claims, damages, liabilities, and expenses arising from your content, your use of the Platform, your forms, your handling of Respondent data, or your breach of these Terms.

18. Governing Law and Disputes

These Terms are governed by the laws of India, without regard to conflict of law principles. Any disputes arising from these Terms or your use of the Platform will be subject to the exclusive jurisdiction of the courts of Mumbai, Maharashtra, India.

19. Changes to These Terms

We may update these Terms from time to time. We will post the updated Terms on our website and update the "Last updated" date above. Your continued use of the Platform after changes take effect constitutes acceptance of the updated Terms.
